The Bill of Rights - A Political History of "American Scripture”

In this talk, Professor Eric Boyer asks two questions: How did the first ten amendments come to be and what guidance can a political history of the Bill of Rights offer?  In answering these questions, Professor Boyer will recreate the political history of the Bill of Rights, a history that is more a tale of bareknuckle political tactics than one of ideals and principled debate.

Does Our Constitution Protect “Fundamental Rights”?

Debates over what, if any, rights should be explicitly protected in the Constitution have raged since our country's founding. With a high-profile abortion rights case making its way to the Supreme Court next term, Professor Eric Boyer will review these debates over so-called “Fundamental Rights,” and ask: are there rights that are so fundamental to liberty that they are protected even in the absence of explicit Constitution language?
