Rights of Complainants and Respondents

Both the complaining student and the responding student have the following rights in regards to conduct hearings addressing violence, harassment, or sexual misconduct/assault.

  1. The right to be notified in writing of the following at least 48 hours before the time of the proceeding:

    a) A description of the behavior alleged to constitute a violation of the Code of Community Responsibility sufficiently specific to allow for the preparation of a response, The time and place of the alleged behavior,

    b) The name(s) of the person(s) reporting the alleged behavior,

    c) The time and place of the hearing, and

    d) Referral to the "Conduct System" section of the Code of Community Responsibility

  2. The right to present evidence and witnesses relevant to his/her defense. The hearing officer or board will review written versions of witness testimony prior to the case and determine if witnesses need present information in person.

  3. The right to have a support person from the Colby-Sawyer community who is not legal counsel at the hearing.

  4. The right to be notified of the outcome of the hearing.

  5. The right to appeal the decision of the hearing officer or board.
